Subsequent to the publication of the Committee agenda the following summarised consultee comments have been received from:

 

Local Highways – No objection subject to conditions.  The officer has clarified in her email dated 9 Oct 25 that “Should the applicant be unwilling to revise the emergency access as recommended or disagree with aspect of the proposed conditions, the LHA would be minded to recommend refusal”.

 

National Highways – “we consider it unlikely that the proposed development would have a severe impact on the operation of, or an unacceptable impact on road safety at, the SRN.  Therefore, our recommendation is that National Highways offers no objection to the Appeal on the planning application”.

 

Yorkshire Water – “Yorkshire water maintains the objection to the application, specifically 'Flood Risk and Drainage Note' 1506/52/CN dated 27/08/2025 as prepared by ARP. This drawing shows foul water to discharge to public foul water sewer does not have sufficient available capacity to accommodate a development of the size proposed”.

I have submitted the Local Highway Authority’s recommendation for the above application via Mastergov.

 

The LHA is keen to ensure that the proposed emergency access is repositioned closer to the adopted section of Westgate Lane. This adjustment is essential not only to secure long-term access for emergency services but also to support sustainable travel into and out of the development. As currently proposed, the emergency link connects further along the private road/public bridleway, which raises concerns regarding long-term accessibility and maintenance. Relocating the access point nearer to the publicly maintained highway and offering it for formal adoption would provide greater certainty and align with the principles of the North Yorkshire Council Design Guide.

 

There is a strong emphasis on promoting sustainable travel within the development to reduce reliance on private vehicles and mitigate the potential increase in traffic along Rainbow Lane. The location and design of the emergency access are therefore critical, both in terms of meeting design standards and supporting active travel modes.

 

Should the applicant be unwilling to revise the emergency access as recommended or disagree with aspect of the proposed conditions, the LHA would be minded to recommend refusal. The access location is a fundamental aspect of the proposal, and its alignment with adopted standards and sustainable travel objectives is necessary to ensure a safe, accessible, and future-proof development.
